For Seller

  • You must be 18 years or older to become a seller.
  • Activation of a ‘shop’ will only be granted to Bruneians, permanent residents or expats with valid Brunei IC.
  • To access and use the Services, you must register for an MBP Marketplace account (“Account”) by providing your full legal name, current address, phone number, a valid email address, and any other information indicated as required in the application form upon setting up a shop. MBP Marketplace may reject your seller’s application, or cancel an existing account, for any reason, in our sole discretion.
  • You acknowledge that MBP Marketplace will use the email address you provide as the primary method for communication.
  • You are responsible for keeping your password secure. MBP Marketplace cannot and will not be liable for any loss or damage from your failure to maintain the security of your Account and password.
  • You are responsible for all activity and content such as links, data, graphics, photos and links that is uploaded under your MBP Marketplace Account. You must not transmit any worms or viruses or any code of a destructive nature.
  • You must not upload or sell prohibited and illegal items such as explicit materials, racist/hatred materials, adult materials, drugs, tobacco, alcohol, and other restricted or regulated products (ie: medical/health and some beauty items/slimming products).
  • For merchants who are selling cosmetic products (including body lotion, soap and etc.), medicine and dietary  supplements, please note that it is merchant’s sole responsibility to ensure their products are in line with the Medicines (Cosmetic Products) Regulations and any other related regulation and guidelines legislated by Brunei Government bodies. All MBP marketplace sellers must agree to take full responsibility in case of violation of such regulations.
  • A breach or violation of any term in the Terms of Service as determined in the sole discretion of MBP Marketplace will result in an immediate termination of your services and/or could be punishable by law.

  • Subject to the person signing up for the Service will be the contracting party (“Account Owner”) for the purposes of our Terms of Service and will be the person who is authorized to use any corresponding account we may provide to the Account Owner in connection with the Service.
  • If you are signing up for the Service on behalf of your employer, your employer shall be the Account Owner. If you are signing up for the Service on behalf of your employer, then you represent and warrant that you have the authority to bind your employer to our Terms of Service.
  • Note that your shop will remain unseen on the shop listing page until you have uploaded at least one product.

You must read, agree with and accept all of the terms and conditions contained in these Terms of Service and the Privacy Policy before you may become a seller.

  • The price of the product to sell or service to offer should be $10 and above.
  • Technical support is only provided to active sellers via email (24hrs) and phone (during office hours).
  • You acknowledge and agree that MBP Marketplace may amend these Terms of Service at any time by posting the relevant amended and restated Terms of Service and such amendments are effective as of the date of posting. Your continued use of the Services after the amended Terms of Service are posted to MBP Marketplace’s website constitutes your agreement to, and acceptance of, the amended Terms of Service. If you do not agree to any changes to the Terms of Service, you may cancel your account anytime.
  • You may not use MBP Marketplace for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in Brunei (including but not limited to copyright laws)
  • You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the MBP Marketplace website without the express written permission.

  • You understand that MBP Marketplace content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit Card information is always encrypted during transfer over networks.
  • You acknowledge and agree that your use of the Service, including information transmitted to or stored by Marketplace, is governed by its privacy policy.

  • We reserve the right to modify or terminate the Service for any reason, without notice at any time.
  • We reserve the right to refuse service to anyone for any reason at any time.
  • Verbal or written abuse of any kind (including threats of abuse or retribution) to any MBP Marketplace administrator, staff, buyer, seller and the management will result in immediate Account termination.
  • MBP Marketplace does not pre-screen content and it is in our sole discretion to refuse or remove any Content that is available on the website during the routine review/filtering process.
  • We reserve the right to provide our services to your competitors and make no promise of exclusivity in any particular market segment. You further acknowledge and agree that MBP Marketplace staff and other members may also become a buyer/seller and that they may also be a competitor, although they may not use your confidential information in doing so.
  • In the event of a dispute regarding Account ownership, we reserve the right to request documentation to determine or confirm Account ownership. Documentation may include, but is not limited to, a scanned copy of your Brunei IC or passport, business license, and other relevant information submitted to us on our site or from the application form.
  • MBP Marketplace retains the right to determine, in our sole judgment, rightful Account ownership and transfer an Account to the rightful owner. If we are unable to reasonably determine the rightful Account owner, MBP Marketplace reserves the right to temporarily disable an Account until resolution has been determined between the disputing parties.

  • We do not claim any intellectual property rights over the material you provide to the MBP Marketplace website. All material you upload remains yours. You remove your shop any time or delete your Account.
  • By uploading Shop Content, you agree: (a) to allow other internet users to view your Shop Content; (b) to allow MBP Marketplace to display and store your Shop Content; and (c) that MBP Marketplace can, at any time, review all the Shop Content you submitted.
  • We will not disclose your confidential information to third parties, except as required in the course of providing our services. Confidential information includes any materials or information provided by you to us, which is not publicly known.

  • You agree that the current merchant rate of 3.5% + B$0.50 per transaction are deducted to your sales amount.
  • You can only withdraw your earnings to your Brunei local bank account. A complete full name of the Account holder, contact details, bank account number and other information submitted to us must always be updated and correct.
  • Before you can withdraw your earning, you have to inform us your bank details in person at our office. Please make an appointment in advance. For security reason, any subsequent change in bank details must also be done in person.
  • You agree that you can only request to withdraw your earnings through the user account page (My Account > My Earnings) after 30 days period from the last date of order. The amount which is eligible to withdraw is reflected as ‘Withdrawable Current Balance'(WTB) on ‘my earnings’ page
  • Upon submitting the request, the full amount of WTB is claimed to our finance department. Note that the platform does not support partial withdrawal of the WTB.
  • Your earnings/claims will be settled and transfer to your bank account within 7 days from the date of request.
    • You remove your shop anytime by clicking the delete button [x] on the ‘My Shop’ page.
    • You can submit a request to terminate your whole MBP Marketplace account via our contact page.
    • Upon termination of the Services by either party for any reason:
      • MBP Marketplace will cease providing you with the Services and you will no longer be able to access your Account;
      • Unless otherwise provided in the Terms of Service, you will not be entitled to any refunds of any fees, pro rata or otherwise;
      • Any outstanding balance owed to MBP Marketplace for your use of the Services through the effective date of such termination will immediately become due and payable in full; and
      • Your shop will be taken offline.
    • We reserve the right to modify or terminate the MBP Marketplace service or your Account for any reason, without notice at any time.
    • Fraud: Without limiting any other remedies, MBP Marketplace may suspend or terminate your Account if we suspect that you (by conviction, settlement, dispute investigation, or otherwise) have engaged in fraudulent activity.

    • MBP Marketplace reserves the right at any time, and from time to time, to modify or discontinue, the Service (or any part thereof) with or without notice.
    • MBP Marketplace shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

    • MBP Marketplace highly recommends the seller to act responsibly to entertain the buyer’s complaint, request for a refund, or request to replace the goods. Each seller must have their own refund and return policy to be clearly stated on the shop page and settle the dispute with the buyer.
    • In most cases, MBP Marketplace will only refund the buyer with the consent of the seller. We have the right to investigate and request for the proof and documents from both parties to help solve the dispute. However, if the buyer is on the right position and the seller lacks appropriate actions and communications between the parties, we will hold the seller’s account and refund the buyer.

    • Please note that it is seller’s sole responsibility to deliver the product at his/her own cost to the buyer, once payment has been made. Seller must proactively to discuss & arrange delivery with the buyer. In the event when delivery cannot be fulfilled, MBP Marketplace reserves the right to cancel the order and proceed refund for the buyer.
    • To facilitate the delivery within Brunei, MBP marketplace offers a collection point for sellers to deliver products to buyers. After a buyer has placed a purchase order, the seller can pass the product with Order Number and seller’s contact to our staff at collection point. The buyer with the correct Order Number can pick up the product at his/her convenience during the opening hour of the collection point. Our staff will inform the seller once the product has been collected.
